National Commission for Protection of Child Rights (NCPCR)

About

National Commission for Child Rights (NCPCR) is a statutory body established in 2007 under the act of parliament, The Commission for Protection of Child Rights Act, 2005. The commission works under the administrative control of Ministry of Women and Child Development. The headquarters of the commission is based in New Delhi.

Composition of Commission

A person of eminence with exemplary work record of children welfare is appointed as chairperson.

There are six additional members, of which at least two are women.

Members are appointed by the Central Government.

The person to be appointed as a member should be a person of eminence and should have experience in the following fields :-

  • Education
  • Child health, care, welfare or  child development
  • Juvenile justice or care of neglected or children with disability
  • In removal of child labour or elimination of distress in children
  • Child psychology or sociology
  • Laws relating to children

 Functions and Powers

Commission strive to ensure that all laws and policies in the country are in accordance with the rights of children as emphasized by Indian Constitution as well as United Nations convention on Rights of Child.

Child : Any person between the age of 0 to 18 years of age.

In simple words, The Commission acknowledges the universality and inviolability of child rights.

The commission is also mandated with responsibility under two different acts, namely :-

  • Protection of Children from Sexual Offence (POSCO) Act, 2012.
  • Right to Education Act, 2009.

Some other Important functions of Commission are :

  • Inquiring into cases related to violation of child rights and initiating proceedings for the same.
  • Examine and reviews safeguards provided by law for protection of child rights.
  • Carry out thorough study of international instruments and treaties and based on it reviews current policies on child rights and protection in the country.
  • Conducts research in the field of child rights.
  • Organize seminars, mass campaigns etc. to promote the idea of child rights.
  • Undertake investigation into specific complaints received from children or anyone else on their behalf and take suo motu notice in matters of :

i) deprivation and violation  of child right.

ii) Non implementation of laws.

iii) Non compliance of policy decision.

  • Reviews school curriculums and encourage inclusion of child rights and also trains teachers in that respect.
  • Present to central government annually or at such other interval as it may deems fit, reports on the working of those safeguards.
