NATIONAL HUMAN RIGHTS COMMISION
- NHRC in India is a statutory body (body which is not built constitutionally but brought by passing a resolution and made as Act, such bodies are known as Statutory Body).
NHRC was constituted on Oct12th 1993.which was established under Protection of Huma Rights, Act 1993 and was amended through Protection of human rights, (Amendment) Act 2006.
The functions of NHRC are like these:
- Its actively inquire into violations of human rights by government of India or negligence of such violation by a public servant.
- Their function of protection of human rights and suggest and recommend the right measures for effective execution.
- Review and monitor the facts inclusive of acts related to terrorism which affect the life of human beings and recommend appropriate measures
- Promote and help develop research in the field of human rights
- It evaluates and confirms the need for protection of human rights
- Encourage the efforts of NGOs and institutions who works in the field of human rights
APPOINTMENT:
Section 2 and 3 of TPHRA (The protection of Human Rights Act) lays down the rules for appointment to the NHRC.The President of India appoints the Chairperson of NHRC and other members on recommendation of a committee which includes:
- The Prime Minister (Chairperson)
- The Home Minister
- The Leader of the Opposition in the Lok Sabha (Lok Sabha)
- The Leader of the Opposition in the Rajya Sabha (Rajya Sabha)
- The speaker of the Lok Sabha
- The Deputy Chairman of the Rajya Sabha

Current chairperson is Arun Kumar Mishra, who is former judge of Supreme court 2021.
STATE HUMAN RIGHTS COMMISION
These may be constituted by state government for their respective states. This power is with the states whether they need to constitute a State Human Rights Commission under amendment brought in TPHRA, 1993.At present ,26 states have constituted SHRC.
