Law vs virus

  • No drunk drivers’ tests to be conducted in Gurugram.
    • This is to protect people from using the same breath analyser that an infected person may have breathed into.
    • However, this can lead to a rise in cases of drunk driving.
  • 5000 prisoners may be released on bail or furloughs to avoid overcrowding.
    • Prisons are already over crowded.
    • There is not much that is done, because prisoners don’t vote.

Gang-rape convicts hanged

  • What is rarest of the rare doctrine?
    • Supreme Court has come with the new concept of rarest of the rare.
    • Not everyone is to be given a death penalty.
    • For e.g. an illiterate man is a result of failure of the state, thus, he is not to be given death sentence.
    • Similarly, a person who has an old widow mother is not to be awarded death sentence because it would inflict a punishment on her as well.

    • Read together, these translate into the fact that every person is to be given adequate legal opportunity for protection of their life.
  • Are women safe?

    • Many states have enacted laws providing for capital punishment in case of rapes.

      • Attitude change,
      • Glass ceiling,
      • Representation to women,
      • gender stereotyping, etc
